Florida Sues OpenAI Over Data Privacy Violations

Florida became one of the first states to file a legal action directly against OpenAI, alleging its AI products violated state consumer data privacy laws. The lawsuit places OpenAI in direct confrontation with state-level enforcement rather than federal regulators alone.

State privacy statutes increasingly govern how companies collect, store, and process personal information from residents. Florida’s complaint alleges OpenAI’s AI products failed to meet those requirements in ways that harmed consumers.

Direct state suits against AI providers represent an escalation beyond legislative hearings and voluntary commitments. OpenAI will need to mount a defense rooted in both technical data-handling practices and legal interpretations of state privacy frameworks.

The case could establish precedent for how other states pursue similar actions against large language model companies. Florida’s filing signals that state attorneys general view AI products as within the scope of existing consumer protection authority.
