Functioning under the Department for Promotion of Industry and Internal Trade, the intellectual property regulator reiterated that under the provisions of the Copyright Act, 1957, copyright protection is fundamentally predicated upon human authorship. The circular clarified that legal authorship cannot be recognized in software algorithms or automated artificial intelligence models alone. For a creative work to qualify for copyright registration, the applicant must establish substantial human intellectual effort, creative judgment, and original expression in shaping the final output.
The guidelines stipulate that purely prompt-driven outputs lacking substantive human creative modification or arrangement remain ineligible for statutory protection. However, AI-assisted works where a human creator uses generative technology as a subsidiary tool—retaining dominant artistic control over composition, editing, and synthesis—remain eligible for registration, provided full disclosure of the technological process is submitted.
Intellectual property practitioners described the clarification as a welcome benchmark that aligns domestic copyright jurisprudence with evolving international standards while offering clarity for creative industries adopting digital tools.
The circular aligns India’s intellectual property framework with rulings by the United States Copyright Office and European Union regulatory directives, which similarly exclude fully synthetic or automated outputs from copyright protection. Legal experts noted that creative professionals using AI for preliminary drafting, color grading, or syntactic refinement retain valid authorship rights provided their creative contribution remains demonstrably distinct.
