Under current statutory provisions, tax enforcement authorities retain discretionary powers to effect summary arrests for specified threshold infractions, a mechanism that business chambers argue is frequently leveraged to enforce disputed tax liabilities before formal judicial adjudication. The contemplated legislative amendments would restrict coercive criminal prosecution strictly to premeditated, organized syndicates generating fictitious invoices or engaging in fraudulent input tax credit circular trading.

Trade industry federations and chartered accountant associations lauded the policy direction, describing decriminalization as a mature evolution of India’s indirect tax jurisprudence. Legal experts observed that replacing detention powers with administrative monetary penalties and digital audit checks will enhance voluntary compliance while protecting bona fide traders from arbitrary enforcement actions.
